Plaintiff, Florence Russell, was injured while a passenger in an automobile driven by Helen Gritton, and owned by the latters husband, when it was struck by an automobile driven by Sharon Mitchell, an uninsured motorist. Sharon was killed in the accident and the administrator of her estate was named a defendant. Also named as defendants were two insurance companies, United Pacific Insurance Company and Factory Mutual Liability Insurance Company of America. Plaintiff was granted a default judgment of $10,000 plus medical expenses against Sharon Mitchells administrator. United settled, without answering the complaint, for the sum of $4,500. A summary judgment was entered against Factory in the amount of $5,000, and the latter prosecutes this appeal.
